[0]Reservoir Hill writes "Randall Stross has an insightful article in the
NY Times that says that if Microsoft thinks this is the right time to try
a major acquisition on a scale it has never tried before, it should
[1]pursue not Yahoo but SAP, another major player in business software,
thus merging Microsoft's strength with that of another. This is more
likely to produce a happy outcome than yoking two ailing businesses,
Yahoo's and Microsoft's own online offerings, and hoping for a miracle.
Stross points to Oracle as a company whose acquisition strategy has
picked up key products and customers while avoiding venturing too far
from its core business, or overpaying. Stross recommends that Microsoft
acquire SAP and leave it alone as an autonomous division ��� which would
avoid a culture-clash integration fiasco. Besides, large enterprise
customers are arguably the best customers a software company can have. A
few dozen well-paying Fortune 500 customers may actually be more valuable
than tens of millions of Web e-mail 'customers' who pay nothing for the
service and whose attention is not highly valued by online advertisers."

[0]Chris Gregerson writes "I work as a stock photographer/web developer.
I saw a [1]photo of mine used in Vilana Financial's full-page [2]phone
book ad. They wouldn't pay the licensing fee, and I [3]wrote about it
online ([4]mirror). They sued me for defamation, producing a sales
agreement signed by one ' Michael Zubitskiy' (who they said took the
photo and sold the rights to them). I sued them for copyright
infringement, and they added claims against me for trademark
infringement, deceptive trade practices, and tortuous interference. There
was a trial I'll long remember on the 5th of November, and the judge
recently issued her [5]verdict (PDF; [6]mirror). She ruled Vilana
Financial forged the sales agreement and willfully infringed my photos,
and awarded me $19,462. All claims against me were denied. I represented
myself during the litigation."

rhetorical question, 'If you don't have anything to hide, you don't have
a good reason to worry about losing your privacy, right?' This AP story
uncovers a vast, distributed, decentralized [0]epidemic of snooping into
databases of personal information by workers at major utilities, the IRS,
and other large organizations. In a number of cases these incidents have
led to real harm. One striking example involves now ex-Mayor of Milwaukee
Marvin Pratt, who had a pattern of being late paying his heating bills.
This fact was leaked to the media by a utility worker and may have led to
Pratt's losing a bid for re-election. As one can imagine, the harm
becomes much greater when this same snooping is done by Government
officials to deal with political enemies, or [1]by corporations to
uncover whistleblowers."

Trintech writes "A Utah couple acting as their own attorneys [0] have
filed a lawsuit against Apple and Starbucks over the retailers' recent
Song of the Day promotion, which offers Starbucks customers an iTunes
gift card for a complimentary, pre-selected song download. In a
seven-page formal complaint, James and Marguerite Driessen of Lindon,
Utah say they developed in 2000, and were granted a patent in February
2006 for, an Internet merchandising utility dubbed RPOS (retail point of
sale). The concept, which forms the heart of the infringement lawsuit,
would allow gift cards for pre-defined items that can be sold at a
brick-and-mortar store but used online; customers could redeem a card for
a dining room set or a DVD, for example."

The NYTimes has a feature about software development systems that move
the [0]Web offline and desktop applications online, with a focus on Adobe
Air, which will be released tomorrow. The article has quotes from the
developer behind Microsoft's Silverlight (he was a colleague at
Macromedia of Adobe's Air guy), and from the head of the Mozilla
Foundation about their online/offline offering, Prism.

Allen54 noted a followup to yesterday's story about [0]Pakistan's
decision to block YouTube. He notes that "The telecom company that
carries most of Pakistan's traffic, [1]PCCW, has found it necessary to
shut Pakistan off from the Internet while they filter out the malicious
routes that a Pakistani ISP, PieNet, announced earlier today. Evidently
PieNet took this step to enforce a [2]decree from the Pakistani
government that ISP's must [3]block access to YouTube because it was a
source of blasphemous content. YouTube has announced more granular routes
so that at least in the US they supercede the routes announced by PieNet.
The rest of the world is still struggling."

stats that sounded a little hard to believe. My immature side finds it
funny and my more mature side is interested in the legal aspects." For

post about an experiment on players' emotional reactions to [1]killing
and being killed in a first-person shooters (FPS) with a group of
students who played James Bond 007: Nightfire while their facial
expressions and physiological activity were tracked and recorded
moment-to-moment via electrodes and various other monitoring equipment.
The study found that "death of the player's own character...appear[s] to
increase some aspects of positive emotion." The authors believe this may
result from the temporary "relief from engagement" brought about by
character death. "Part of this has to do with the intriguing aesthetic
question of precisely [2]how the first-person-shooter represents the
player after the moment of death," says Clive Thompson. "This sudden
switch in camera angle ��� from first person to third person ��� is, in
essence, a classic out-of-body experience, of exactly the sort people
describe in near-death experiences. And much like real-life near-death
experiences, it tends to suffuse me with a curiously zen-like feeling."

Bond: Phasic emotional responses to violent video game events" is
available on the web." Obnoxiously this alleged scholarly research is not
available for free, so we'll just have to speculate wildly what it says
based on the abstract.

Australia, have found a process to coat natural fibers such as wool,
silk, and hemp that will automatically remove food, grime, and even
red-wine stains by [1]coating their fibers with titanium dioxide
nanocrystals, which break down food and dirt in sunlight. Titanium
dioxide is a strong photocatalyst and in the presence of ultraviolet
light and water vapor, it forms hydroxyl radicals, which oxidize, or
decompose, organic matter. "These nanocrystals cannot decompose wool and
are harmless to skin," says organic chemist and nanomaterials researcher
Walid Daoud. Titanium dioxide can also destroy pathogens such as bacteria
in the presence of sunlight by breaking down the cell walls of the
microorganisms making self-cleaning fabrics especially useful in
hospitals and other medical settings."

advertising is thought of, and ultimately valued, online. Their new
Engagement ROI tool tries to track a user's ad clicking habits and
distribute the credit over all of the ads that led to an eventual sale as
opposed to the last ad clicked getting all the credit. "Say a consumer
sees an ad for a product in a video ad one day, and then clicks on a text
ad to visit the retailer's site the next day, and then eventually sees a
banner ad that leads to a purchase. All of the monetary credit tends to
go to the text link that was clicked on."

Daily Tech is reporting that details about [0]Intel's new processor
models were leaked over the weekend. Both the six core Dunnington and
Nehalem architectures were featured in this leak. "Dunnington includes
16MB of L3 cache shared by all six processors. Each pair of cores can
also access 3MB of local L2 cache. The end result is a design very
similar to the AMD Barcelona quad-core processor; however, each Barcelona
core contains 512KB L2 cache, whereas Dunnington cores share L2 cache in
pairs. [...] Nehalem is everything Penryn is -- 45nm, SSE4, quad-core --
and then some. For starters, Intel will abandon the front-side bus model
in favor of QuickPath Interconnect; a serial bus similar to
HyperTransport."

Court of Appeals has upheld the decision of a Federal judge who threw out
and reversed a jury decision in favor of a patent infringement claim and
ordered the plaintiff's lawyers to [0]pay the defendants' court costs.
U.S. District Senior Judge Richard P. Matsch sanctioned the plaintiff's
attorneys for 'cavalier and abusive' misconduct and for having a 'what
can I get away with?' attitude during a 13-day patent infringement trial
in Denver. With the Appeals Court in agreement, could this case be the
'shot heard round the world' in the revolution against patent trolls?"

[1]rejected the RIAA's 'making available' theory, which is the basis of
all of the RIAA's peer to peer file sharing cases. In Atlantic v.
Brennan, in a [2]9-page opinion [PDF], Judge Janet Bond Arterton held
that the RIAA needs to prove 'actual distribution of copies', and cannot
rely ��� as it was permitted to do in [3]Capitol v. Thomas ��� upon the mere
fact that there are song files on the defendant's computer and that they
were 'available'. This is the same issue that has been the subject of
extensive briefing in two contested cases in New York, [4]Elektra v.
Barker and [5]Warner v. Cassin. Judge Arterton also held that the
defendant had other possible defenses, such as [6]the unconstitutionality
of the RIAA's damages theory and [7]possible copyright misuse flowing
from the record companies' anticompetitive behavior."

Microsoft's latest addition to the server OS market and had a chance to
poke around inside [0]Windows Server 2008. It seems that the new release
is a vast improvement over older versions in both security and
performance but still lacking in several key areas. "There's even a
minimalist installation called Windows Server Core that can run various
server roles (such as DNS, DHCP, Active Directory components) but not
applications (like SQL Server or IIS dynamic pages). It's otherwise a
scripted host system for headless operations. There's no GUI front end to
a Windows Server Core box, but it is managed by a command line interface
(CLI), scripts, remotely via System Manager or other management
applications that support Windows Management Instrumentation (WMI), or by
Remote Terminal Services. It's also a potential resource-slimmed
substrate for Hyper-V and virtualization architectures."

maker, has [0]won its initial suit against Desire2Learn. Blackboard gets
$3.1 million and can demand that Desire2Learn stop US sales. (We
discussed Blackboard when the [1]patent was issued in 2006) This blog
provides [2]background on the suit. Blackboard has been granted a patent
that covers a single person having multiple roles in an LMS: for example,
a TA might be a student in one class and an instructor in another. You
wouldn't think something this obvious could even be patented, but so far
it's been a very effective weapon for Blackboard, badly hurting
Desire2Learn and generating a huge amount of worry for the few remaining
commercial LMSs that Blackboard has not already bought, and open source
solutions such as Moodle (Blackboard's [3]pledge not to attack such
providers notwithstanding)."
